1. Acceptance of These Terms
By accessing or using ElectriCheck (“the Service”), you agree to be bound by these Terms of Service. If you do not agree, you must not access or use the Service.
2. Description of the Service
ElectriCheck is a web-based software platform that provides:
- AI-assisted visual observations from uploaded or captured images
- Automatically generated explanatory text based on visible information
- Exportable reports (PDF or similar formats)
- A user dashboard to organise and manage reports by project
The Service is intended to support documentation and reporting workflows only. Features may be modified, added, or removed at any time.
3. Important Disclaimer – Visual Observations Only
ElectriCheck provides visual observations only.
The Service does not:
- Perform electrical testing, measurements, or verification
- Verify compliance with AS/NZS 3000 or any other standard
- Provide inspection, certification, approval, or sign-off
- Replace professional judgement, site inspection, or engineering assessment
You acknowledge and agree that:
- AI-generated outputs may contain errors, omissions, or misinterpretations
- Images may not show all relevant conditions, defects, or hazards
- All outputs must be reviewed, verified, and interpreted by a licensed electrical professional
- ElectriCheck is not responsible for decisions, actions, or work performed based on its outputs
ElectriCheck is a documentation support tool, not a professional assessment or compliance service.
4. User Responsibilities
You agree to:
- Provide accurate and current account information
- Upload or capture only content you have the legal right to use
- Ensure uploaded images do not breach privacy, confidentiality, or applicable laws
- Not upload unlawful, misleading, offensive, or harmful content
- Not attempt to reverse-engineer, interfere with, or disrupt the Service
You remain fully responsible for how reports and outputs are used.
5. Accounts & Security
You are responsible for:
- Maintaining the confidentiality of your login credentials
- All activity occurring under your account
If you believe your account has been compromised, you must notify us immediately.
6. Subscriptions, Free Trials & Billing
ElectriCheck may offer paid subscriptions and free trials. Payments and subscriptions are managed by Stripe.
Free Trial
- A time-limited free trial may be offered to eligible new users
- Trial eligibility and duration are determined by ElectriCheck
- Trials are not intended to be repeated for the same customer
Paid Subscriptions
- Pricing is displayed clearly at checkout
- Subscriptions renew automatically unless cancelled
- Cancellation takes effect at the end of the current billing period
- No refunds are provided except where required under the Australian Consumer Law
- Usage limits or feature restrictions may apply depending on the selected plan
7. Cancellation, Reactivation & Data Retention
If you cancel your subscription:
- Your paid access ends at the end of the billing period
- Your account remains active
- Previously generated reports remain accessible in your dashboard
If you later reactivate:
- Your existing reports will remain available
- No data is deleted solely due to cancellation
Reports and dashboard data are retained until you delete them manually or you request account deletion.
8. Camera, Storage & App Permissions
The web application (and any future mobile applications) may request permission to:
- Access the camera to capture images
- Access the photo library or file system
- Use local storage for temporary data
Denying permissions may limit functionality.
Apple and Google are not responsible for the Service and have no obligation to provide support.
9. Intellectual Property
ElectriCheck owns all rights to:
- The software, platform, and source code
- Branding, UI, design, and templates
You retain ownership of:
- Uploaded images
- Notes, project names, and report metadata
You are granted a licence to use generated reports for internal business or client documentation.
You must not:
- Resell or redistribute the Service
- Present ElectriCheck as your own software
- Copy or reproduce substantial parts of the UI or code
10. Limitation of Liability
To the maximum extent permitted by law, ElectriCheck and its owner are not liable for:
- Electrical incidents, defects, or compliance outcomes
- Business interruption, financial loss, or loss of data
- Errors or omissions in AI-generated outputs
- Issues caused by third-party services (including Supabase, Vercel, Google Gemini, Stripe, and email providers)
The Service is provided “as is” and “as available”, without warranties of accuracy or completeness. Nothing in these Terms limits your rights under the Australian Consumer Law.
11. Suspension or Termination
We may suspend or terminate access if a user:
- Breaches these Terms
- Poses security or operational risks
- Engages in unlawful activity
Users may request account deletion at any time.
12. Governing Law
These Terms are governed by the laws of Victoria, Australia.
